1. Who we are
Daily Jewish ("the Service", "we", "us") is operated by D. Soesan ("the Seller"), an individual sole proprietor. By using the Service you are entering into an agreement with D. Soesan.
2. Acceptance
By creating an account or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm that you are of legal age in your jurisdiction or have the authority to bind any organization on whose behalf you act.
3. The Service
Daily Jewish provides a Jewish daily-practice companion: prayer tracking, a siddur, parsha readings, the Hebrew calendar, kosher information, and related content. The Service is provided "as is" and we do not guarantee uninterrupted or error-free operation.
4. Acceptable use
You must not misuse the Service. In particular you must not: (a) use it for any unlawful purpose; (b) commit fraud or send spam; (c) infringe intellectual property rights; (d) interfere with the security or integrity of the Service, including by introducing malware, probing, scraping, or attempting unauthorized access; (e) resell or redistribute the Service; or (f) reverse engineer or circumvent any technical limits.
5. Accounts
You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it up to date.
6. Intellectual property
All software, design, branding, and original content of Daily Jewish are owned by D. Soesan and protected by applicable IP laws. You receive a limited, non-exclusive, non-transferable right to use the Service as offered. Public-domain liturgical and Torah texts retain their respective public-domain status.
7. Suspension and termination
We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time.
8. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Daily Jewish does not constitute religious, legal, medical, or professional advice — please consult qualified authorities for halachic or other rulings.
9. Limitation of liability
To the fullest extent permitted by law, the Seller's aggregate liability arising out of or in connection with the Service shall not exceed any amount you have paid in the twelve months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is prohibited by law.
10. Indemnity
You agree to indemnify the Seller against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
11. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the Seller's place of residence, without regard to conflict-of-laws rules. Disputes shall be resolved by the competent courts of that jurisdiction, unless mandatory consumer-protection laws of your country provide otherwise.
